GENERAL TERMS AND CONDITIONS OF MYSTERY MAKERS

Orders from Mystery Makers ApS If you as a buyer place an order at www.mystery.at, you conclude a contract with the seller:

1.1.1. If the buyer concludes a contract with the seller, the buyer accepts these general terms and conditions, which should be read carefully before the purchase.

1.2. An order is only finalised when the seller has sent the buyer a booking confirmation with a reservation ID.

1.2.1 If the buyer has placed an order, the buyer will receive a receipt which is a reproduction of the order placed. The receipt is not an indication that the order has been processed or that a purchase contract has been concluded

1.2.2 It is the buyer's responsibility to check that the booking confirmation - activity, number of participants, date and time - matches the order. If this is not the case, the buyer must contact the seller as soon as possible and no later than 24 hours after receiving the booking confirmation. www.mystery.at/kontakt so that the order can be corrected.

  1. Validity 

2.1 The seller draws attention to the fact that a booking is only finally valid once the seller has sent the booking confirmation. The booking of experiences etc. is only valid for the date and time stated on the booking confirmation.

2.2 The seller reserves the right to present the buyer with a valid booking confirmation upon participation.

  1. delivery 

3.1 Once the seller has confirmed the purchase of an experience and/or gift voucher via the website, the booking confirmation and/or gift voucher will be sent to the buyer by email. Gift vouchers are non-refundable and cannot be exchanged for cash value

  1. Loss of voucher

4.1 If the buyer's voucher is lost, a new one can be requested by contacting the seller at www.mystery.at/kontakt contact us. However, it is necessary that the buyer can present a valid photo ID and correctly state the telephone number and e-mail address used for the purchase.

  1. Prices and payment

5.1 All prices are quoted in euros and include statutory VAT

5.2 The under www.mystery.at Prices quoted are valid at the time of purchase. The seller reserves the right to change the prices. However, this does not apply to orders that are accepted after submission of the booking confirmation

5.3 The total price accepted by the buyer when sending an order is the amount charged by the seller from the payment card used to confirm the booking.

5.4 Under www.mystery.at the buyer can pay with the following payment cards:

5.4.1 Transaction fees will be disclosed prior to acceptance of the purchase and will not exceed the fixed rates set by Nets.

5.4.2 When the buyer places an order, the payment card used is authorised. If the card is not authorised, the buyer receives a message on the screen that the authorisation has failed and is then asked to select another payment method.

5.4.3 For orders placed on the seller's website www.mystery.at full payment is required.

5.5 If the Buyer places an order by telephone or email via the Seller's booking department, full payment is due no later than 4 weeks (28 days) before the date of the booked event.

5.5.1 If less than 4 weeks have elapsed between the order being placed and the date of the event, full payment is required immediately.

5.6 An invoice fee of 7 euros will be charged for payment by invoice. The buyer will receive an invoice the day after the event. The invoice has a payment period of 14 days.

  1. Cancellation and right of withdrawal

6.1 Cancellation occurs when the buyer makes a cancellation or similar changes to the agreed services. Cancellation of events must be made in writing to www.mystery.at.

6.2 The purchaser has the right to withdraw from the purchase free of charge and to cancel the booking up to 4 weeks (28 days) before the date of the booked event. Thereafter, the purchase is legally binding. 

  1. Change of date

7.1 Requests to postpone a booking to a new date must always be sent in writing to the seller at www.mystery.at/kontakt be addressed.

7.2 The purchaser may request that the booking be postponed to a new date free of charge up to 2 weeks (14 days) before the date of the booked event.

7.3 If there are less than 2 weeks (13 days) until the date of the booked event, the buyer can change the date of the booking for a fee. The fee covers administration, scheduled staff and any lost sales opportunities. The fee is 15% of the total amount of the purchase.

7.4 The seller can never guarantee that the buyer's newly requested date and time will be available.

7.4.1 The transfer also requires that the payment terms and due date of the original booking are adhered to. 

7.4.2 The booking is still bound to the trading conditions of the original booking.

7.4.3 The option to change the date of the event only includes the date and time, but not the number of participants or the booked product itself.

7.5 If less than 48 hours remain until the date of the booked event, the buyer can no longer have the booking postponed to a new date.

  1. Change in the number of participants

8.1 The number of participants cannot be reduced once the buyer has placed the order and received the booking confirmation.

8.2 The buyer may increase the number of participants up to 24 hours before the day of the booked event. The adjustment of the number of participants must be made in writing to www.mystery.at/kontakt take place.

8.2.1 The increase in the number of participants is limited by the applicable participant restrictions for the various products of the seller.

8.2.2 Any additional payment required due to an increase in the number of participants must be made at least 24 hours before the date of the booked event.

  1. Change or cancellation of orders with Mystery Makers

9.1 Without being obliged to pay any compensation or otherwise cover the buyer's costs, the seller is entitled to cancel a purchase in the following situations:

  • If under www.mystery.at an unintentional error has occurred, e.g. a payment error.
  • If the buyer has not paid on time or the buyer's payment information cannot be verified or is incorrect.if 
  • The seller suspects that an order has been placed in bad faith or in connection with illegal activities.

9.2 The seller may cancel a purchase due to internal circumstances such as staff illness or shortage of goods. The seller will try to assign the buyer a new date or another product or event. If this is not possible, the seller is obliged to refund the full amount of the service purchased from the seller at no additional cost to the buyer.

9.2.1 The seller is obliged to inform the buyer as soon as possible in the event of the aforementioned circumstances.

9.2.2 Clause 9.2 is limited to cancellation due to internal circumstances at the seller. Information on changes or cancellations due to external circumstances can be found under points 14, 15 and 16.9.

  1. Complaints

10.1 Complaints must be made in writing and received by the seller no later than 8 days after the event. Enquiries must be made in writing to www.mystery.at/kontakt where all enquiries will be answered within 5 working days.

  1. Disputes

11.1 All disputes that www.mystery.at and purchases on this website are subject to Danish law and the Danish courts, unless mandatory law prescribes otherwise.

  1. Marketing

12.1 The seller is authorised to include customers in reference lists for use in marketing. Consent to this is given by accepting the terms and conditions. The Buyer's consent to this can be revoked at any time by written notification to the Seller.

  1. The processing of your personal data

13.1 The seller respects the privacy of the buyer and processes personal data in a natural way in accordance with the legal requirements in the region.

The seller will only pass on the buyer's information (name and organisation) to third parties in connection with the booking of a Mystery Hunt at the Kunsthistorisches Museum Vienna or a Mystery Hunt at the Albertina. 

  1. General limitation of liability

14.1 The seller makes the following limitations of liability:

  • Errors in pricing and sold-out items and events.
  • Printing errors and/or system errors generated by the booking system.
  • Change of seat allocation.
  • The right to refuse the team/individual participants if the museum staff determines that the participants are visibly intoxicated.
  • The right to refuse the team/individual participants if they arrive 15 minutes later than the booked time.
  • The right to refuse the group/individual participant if their participation in the event violates the ongoing handling/management of COVID-19 by the authorities, for example, but not limited to, the presentation of a corona pass (added on 22/11/2021).

15. Impossibility (added on 22/11/2021)

15.1 In the legal context, impossibility is a term for cases in which an obligation cannot be fulfilled, e.g. due to legal prohibitions or practical impossibility.

15.1.1
 The buyer's right to a financial refund of the purchased service from the seller expires if the seller is unable to fulfil the agreement/event agreed between the parties (buyer and seller) due to impossibility. Impossibility includes, but is not limited to, the event not being able to be held at a particular location if it is unexpectedly closed to the public. Impossibility also includes, but is not limited to, the event not being able to be held due to COVID-19 legal or health reasons.

15.1.2 The seller is obliged to notify the buyer as soon as possible in the event of impossibility as described in points 15.1 and 15.1.1

15.1.3
 In the event of impossibility, the seller shall offer the buyer a new date or another event as described in points 15.1 and 15.1.1

16. Force majeure (added on 22/11/2021)

16.1
 Force majeure is defined in the legal lexicon as "[...] certain external acts, events or circumstances beyond the control of the parties [...]".

16.1.1
 The buyer's right to a financial refund of the purchased service from the seller expires if the seller is unable to perform the event agreed between the parties (buyer and seller) due to force majeure, including, but not limited to, natural disasters, floods, fire, war, terror, power outages, diseases, epidemics or pandemics.

16.1.2
 The seller is obliged to notify the buyer as soon as possible in the event of force majeure.

16.1.3
 The seller will endeavour to allocate a new date or another event to the buyer, but is not obliged to do so.
